TERMS OF SERVICE

§ 1 Scope and Subject Matter
(1) These Terms and Conditions apply to all courses, workshops and masterclasses offered by Bild-Werk Frauenau e.V. (hereinafter “Bild-Werk”).
(2) The International Summer Academy takes place annually in several course blocks between May/June and September. Additional shorter workshops and masterclasses are offered during autumn and winter.
(3) Participation is open to persons aged 18 years and older.
§ 2 Registration and Conclusion of Contract
(1) Registration must be made using the designated registration form (online or in text form).
(2) By submitting the registration, the participant makes a binding offer to conclude a contract.
(3) The contract is concluded only upon written confirmation of registration by Bild-Werk.
§ 3 Course Fees and Material Costs
(1) The applicable course fee is stated in the respective course description.
(2) Unless explicitly stated otherwise, material costs are not included in the course fee and will be charged separately according to actual consumption.
(3) Participants will be informed about additional material costs at the beginning of the course.
(4) Accommodation and catering costs are not included.
§ 4 Discounts
(1) Pupils, students and unemployed persons receive a 20% discount upon presentation of valid proof.
(2) Members of Bild-Werk Frauenau e.V. receive a discount of €25 once per calendar year.
(3) Discounts cannot be combined unless expressly stated otherwise.
§ 5 Payment Terms
(1) A reservation fee of 30% of the course fee becomes due upon confirmation of registration.
(2) The remaining balance must be paid no later than two weeks prior to the start of the course.
(3) Timely receipt of payment shall be decisive.
§ 6 Cancellation by Participant
(1) Cancellation is possible at any time prior to the course start in text form.
(2) In case of cancellation, Bild-Werk may charge the following lump-sum compensation:

§ 7 Cancellation by Bild-Werk
(1) Bild-Werk reserves the right to cancel a course for good cause, in particular in cases of:

(4) No claim for reimbursement of travel or accommodation costs shall arise unless caused by intentional or grossly negligent conduct.
§ 8 Liability
(1) Bild-Werk shall be liable without limitation for damages resulting from injury to life, body or health.
(2) For other damages, liability shall apply:

(5) No liability is assumed for loss or damage to personal belongings, unless caused intentionally or by gross negligence.
(6) Participants must follow safety instructions and staff directions.
§ 9 Use of Machinery
(1) Machinery may only be used after proper safety instruction.
(2) Chainsaws may only be used with appropriate protective equipment and proof of qualification.
(3) Bild-Werk may define usage conditions and time restrictions.
§ 10 Photo and Video Recordings
(1) Photo and video recordings may be made for documentation and public relations purposes.
(2) Publication shall only take place on the basis of a separate voluntary consent pursuant to Art. 6(1)(a) GDPR.
(3) Consent may be revoked at any time with future effect.

§ 11 Applicable Law and Jurisdiction
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the contracting party is a merchant or public legal entity, the place of jurisdiction shall be the registered office of Bild-Werk.
(3) Statutory places of jurisdiction apply to consumers.

- less than 20 days before course start: 50% of the course fee
- no-show or withdrawal after course start: 100% of the course fee

§ 7 Cancellation by Bild-Werk
(1) Bild-Werk reserves the right to cancel a course for good cause, in particular in cases of:
- insufficient number of participants (fewer than three),
- illness of the instructor,
- force majeure or other impossibility of performance.
(3) Further claims shall be excluded unless mandatory statutory provisions provide otherwise.
(4) No claim for reimbursement of travel or accommodation costs shall arise unless caused by intentional or grossly negligent conduct.

- in cases of slight negligence only for breach of essential contractual obligations, limited to foreseeable typical damages.
